Overview

The Book of Qiraad (Mudaraba, profit-sharing partnership) is the eighteenth book of the Muwatta in the transmission of Yahya ibn Yahya al-Laythi from Malik ibn Anas, in the edition of Bashshar Awwad Ma'ruf (1997), in the second volume. It occupies pages 221 to 237 in the PDF pagination, and contains 42 numbered texts (2007–2048) in fifteen chapters. It concerns qiradh and its conditions, what is lawful and unlawful in it, and its debts and expenses. 1 2

What the book gathers

  • What is reported on qiradh (2007–2008): Umar's qiradh to his two sons with money from Abu Musa al-Ash'ari, and Uthman's qiradh. 1 3
  • What is and is not permitted in qiradh (2009–2016): the customary form of qiradh, expenses, debt, goods, and usury. 3 4
  • Conditions in qiradh (2016–2023): what may be stipulated, and what may not, concerning pure profit, zakat, guarantee, and term. 4 5
  • Qiradh in goods, rent, transgression, expenses, debt, advance payment and accounting (2024–2048): losses, theft and transgression that may occur, and when profits are divided. 5 2

Malik's method in the book

Malik builds the rulings of qiradh on the practices known among people, saying "and that is the matter with us", and returns disputes between the agent and the owner of capital to a qiradh of the same kind. He forbids any condition in qiradh that would turn it into hire, usury or uncertainty. 6 4

The editor's notes

The editor quotes Ibn Abd al-Barr on a wording of a hadith that Malik alone transmitted, and points out that some hadiths of the book are cut off. 4 6

Its place in the museum

Each text of the book has its own record. It names the highest narrator and the chapter, gives the substance of the report in the museum's own wording, and records the editor's takhrij where it is needed. See Qiradh for the places where its rulings appear in the book. 1
