Summary
Yahya said Malik said of a man who gave another money for profit-sharing, who worked with it and made a profit, then bought from the profit or the whole of it a slave-girl, had intercourse with her, and she became pregnant by him, then the money was lost. Malik said: if he has money, the value of the slave-girl is taken from his money, and the money is restored with it. If there is an excess after the money is repaid, it is divided between them according to the first profit-sharing. If he has no money to repay it, the slave-girl is sold until the money is restored from her price. 1
