Summary
Malik says of a man who gives another money for profit-sharing and stipulates for himself a portion of the profit exclusively, not shared with the other party: that is not proper, even if it is one dirham. Unless he stipulates half the profit for himself, half for his partner, or a third, a quarter, or less or more than that. When he names any part of it, small or large, every part named is lawful, and that is the profit-sharing of Muslims. But if he stipulates that he has one dirham of profit or more exclusively for himself, and the rest of the profit is divided between them in halves, that is not proper, and it is not the profit-sharing of Muslims. 1
