Summary
Malik says: it is not proper for the one who gives money in profit-sharing to stipulate on the one who takes it that the zakat on his share of the profit be borne by him exclusively. If the owner of the money stipulates that, he has stipulated for himself an established excess of profit in what is removed from him, from the zakat that falls on his share. It is not lawful for a man to stipulate on the one who works with his money that he buy only from a named man, because that makes him a messenger for a wage that is not known. 1
