Summary
Malik transmits from Yahya ibn Said, from Bashir ibn Yasar, who told him that Abdallah ibn Sahl al-Ansari and Muhayyisa ibn Masud went out to Khaybar and separated on their errands; Abdallah ibn Sahl was killed. Muhayyisa came back, and he and his brother Huwayyisa and Abd al-Rahman ibn Sahl came to the Prophet ﷺ. Abd al-Rahman was about to speak because of his position as the brother, and the Prophet said: the eldest, the eldest. Huwayyisa and Muhayyisa spoke and mentioned the affair of Abdallah ibn Sahl. The Prophet said to them: will you swear fifty oaths and claim the blood of your companion or your killer? They said: Messenger of God, we did not witness it and were not present. He said: then should the Jews clear themselves with fifty oaths? They said: how can we accept oaths from a people who are unbelievers? Yahya ibn Said said: Bashir ibn Yasar claimed that the Prophet paid the blood-money from his own. The editor notes that Ibn Abd al-Barr counted it as a broken report in Malik's transmission, and that the report of Sahl alone is connected in the two Sahihs. 1
