Summary
Malik was asked about a man of Mecca who went out to garrison duty or some journey, then returned to Mecca intending to stay, and entered with the lesser pilgrimage in the months of the pilgrimage, then began the pilgrimage, and his lesser pilgrimage was from the prophetic station or nearer: is he an enjoyer? Malik said: he does not owe what an enjoyer owes of offering or fasting, because God said: that is for one whose family are not present at the Sacred Mosque (Al-Baqara Al-Baqara 196). The editor notes that Abu Musab transmitted it from Malik. 1
