Summary
Malik transmits from Yahya ibn Said, from Sulayman ibn Yasar, that Said ibn Hazzaba al-Makhzumi was felled on part of the road to Mecca while in ihram; he asked who was in charge of the water, and found Abdullah ibn Umar, Abdullah ibn al-Zubayr and Marwan ibn al-Hakam; he told them what had happened to him; each of them ordered him to treat himself with what he could not do without and pay the ransom, and when he was healthy to perform the lesser pilgrimage and come out of his ihram, and then owe the pilgrimage in a later year and give whatever offering he can afford. The editor notes that this is Malik's ruling on one held back without an enemy. 1
