Summary

A saying of Malik: all that you are asked about the inheritance of residuaries is of this kind. Trace the deceased and those among his residuaries who dispute his right of inheritance. If you find one of them reaches the deceased through a father whom none of the others reaches, give the inheritance to the one who reaches him through the nearer father, not to the one who reaches him through a more distant one. If you find them all reaching one common father, look at which is nearer in lineage. The editor notes that Malik cites the verse on the kin in Surat al-Anfal. 1
