Summary
A saying of Malik: whoever dies owing a vow of freeing a slave, fasting, charity or a sacrificial camel, and bequeaths that it be fulfilled on his behalf from his property: charity and the camel come out of his third before other bequests, except what is like them; for what is owed by vow or otherwise is not like voluntary giving, so it is placed in his third only, not in his capital, because if it were allowed from his capital, he would delay other obligations owed by the deceased. The editor notes that Abu Musab transmitted it from Malik (833). 1
