«وإنما تؤخذ الصدقة من أوساط المال»
A verbatim excerpt of the text, forty words at most; the full text is in the edition cited under sources
Chain of transmission
- Malik ibn Anas
- Ziyad ibn Saad
- Muhammad ibn Shihab al-Zuhri
Summary
Malik transmits from Ziyad ibn Sad that Ibn Shihab said: the poorest types of date (ja'ur, misran al-fa'ra and adhq Ibn Habiq) are not taken as zakat from palm owners; they are counted against their owner, and nothing is taken from them as charity. Malik said: the example is sheep, counted against their owner with their young, and the young is not taken in charity. Some property has fruits not taken as charity, like papyrus; the lowest of them is not taken, nor the best; charity is taken from the middling property. The editor notes that Abu Musab, Sa'id ibn Afir and Yahya ibn Bukayr transmitted it, and that Ibn Abd al-Barr reported it from Ibn Shihab from Abu Umama ibn Sahl from his father from the Prophet ﷺ; the editor considers the connected version weak. 1
