Summary
Malik said of one who confesses to adultery against himself, then retracts and says: I did not do it, it was on such and such a way for something he mentions: his retraction is accepted and the prescribed punishment is not applied to him, because God's prescribed punishment is not taken except on upright testimony that stands against its owner, or by confession which he maintains until the prescribed punishment is applied. If he maintains his confession, the prescribed punishment is applied to him. 1
