Summary
Malik transmits from Nafi that a slave who was in charge of the slaves of the fifth (khums) forced a slave-girl from those slaves, and had intercourse with her. Umar ibn al-Khattab (may God be pleased with him) flogged him and exiled him, and did not flog the slave-girl, because he had forced her. 1
