Summary
Malik said: likewise, if a man buys a slave-girl who is pregnant, the slave-girl and what is in her belly belong to the buyer, whether he stipulated it or not. It is not lawful for the seller to exclude what is in her belly, because that is uncertainty that reduces her price, and one does not know whether it will reach him or not; it is like one who sells a foetus in its mother's belly, which is not lawful. 1
