Summary
Yahya transmits from Malik, from Ibn Shihab, from Haram ibn Said ibn Muhayyisah, that a she-camel of al-Bara ibn Azib entered a people's orchard and damaged it, so the Messenger judged that the owners of orchards must guard them during the day, and that what livestock damages at night, its owners are liable for. The editor notes that all Malik's narrators transmitted it as mursal, that disagreement over it from Ibn Shihab is great, and that the report, though mursal, is famous among the jurists of the Hijaz. 1
