Summary
Malik transmits from a man of Kufa that Umar ibn al-Khattab (may God be pleased with him) wrote to a commander of an army he had sent, mentioning that some men of his were pursuing a non-Arab, until he took refuge in the mountain and was resisting, so a man said to him: do not fear; and when he reached him he killed him. Umar swore he did not know of anyone who did this but he would strike his neck. Yahya said: I heard Malik say: this hadith is not agreed upon, and it is not acted upon. The editor notes this is as stated. 1
