«مَن قَتَلَ قَتِيلًا، لَهُ عَلَيْهِ بَيِّنةٌ، فَلهُ سَلَبهُ»

Summary

Yahya ibn Yahya transmits from Malik, from Yahya ibn Said, from Umar ibn Kathir ibn Aflah, from Abu Muhammad, client of Abu Qatada, from Abu Qatada ibn Rib'i, that he said: we went out with the Messenger of God ﷺ in the year of Hunayn. When we met, the Muslims were routed; he saw a polytheist man overpowering a Muslim man, and struck him from behind on the shoulder-muscle; he then turned on him and embraced him, then released him. Umar said: what is the matter with people? He said: the command of God. Then the Messenger of God said: whoever kills an enemy for whom he has evidence, has his spoils; he said this three times, until a man said: he is right, Messenger of God, and the spoils of that slain man are with me. Abu Bakr said: no, by God; one would not go to a lion of God's lions who fights for God and His Messenger and give you his spoils. The Messenger of God said: he is right, so give him his spoils. I sold the coat of mail and bought with it an orchard in Banu Salama; it was the first property I acquired in Islam. The editor notes that the correct name is Umar ibn Kathir ibn Aflah in the narrations of most transmitters. 1
