Summary
Yahya said: Malik said: the oath of fifty applies to accidental killing. The claimants of the blood, who are entitled to it by their oath, swear fifty oaths divided according to their shares of inheritance of the blood-money. If the oaths leave fractions when divided among them, one looks to whom the larger share of those oaths falls, and that oath is completed by him. Malik said: if the victim has no heirs but women, they swear and take the blood-money. If he has only one heir, that man swears fifty oaths and takes the blood-money. This applies to accidental killing and not to deliberate killing. 1
