Summary

Malik said: the matter agreed among us, and what I heard from those trusted in the oath of fifty, and what the imams agreed on in old and new times, is that the oath begins with the claimants to the blood, who swear. The oath of fifty is due only on one of two grounds: either the victim says: my blood is with so-and-so, or the heirs bring a presumption (lawth) of evidence, though not conclusive evidence against the accused. This is what makes the oath of fifty due to the claimants against those they accuse; we hold that it is due only on one of these two grounds. 1
