Summary
A saying of Malik: the matter agreed among us is that palms are estimated against their owners while their fruit is on the heads of the palms, when it is ripe and its sale is due, and their charity is taken of the dates at the harvest. If blight befalls the fruit after it is estimated and before it is picked, and it covers all the fruit, then no charity is due on them. If what is left of the fruit reaches five wasqs or more by the Prophet ﷺ's sa', its zakat is taken from them and nothing is due on what the blight took. Malik said: the same practice applies to vines. 1
