Summary
A saying of Malik: the practice among us regarding the distribution of charities is that it is done only by the ruler's judgment: whichever category has the greatest need and number is given preference according to what the ruler sees; it may shift to the other category after a year or more, so those in need and in number are given preference wherever they are. The people of knowledge whom he trusts followed this. Malik said: the collector of charities has no set share except as much as the imam sees fit. 1
