Summary

The first text in the chapter on charity among partners. Malik says: two partners are associates (khalitan) when the herder is one, the stallion is one, the pen is one and the bucket is one, even if each knows his property from his partner's; the one who does not know his property from his partner's is not an associate but a partner. Charity is not due on two associates until each of them has what charity is due on: if one has forty sheep or more and the other fewer, the charity is on the one with forty alone; if each has a threshold, they are gathered together and charity is due on both; if one has a thousand sheep and the other forty, they are associates and settle the surplus between them equally according to the number of their properties. 1
