Summary
Yahya said: I heard Malik say: the Sunna among us regarding a slave's offence is that whatever a slave inflicts, a wound he inflicts on a person, something he takes by stealth, a sheep he wrongly preserved, fruit he hangs and cuts or ruins, or a theft for which there is no hand-amputation, is charged to the slave's neck, which is no more than the neck, however little or much it is. If his master wishes to pay the value of what his slave took or spoiled, or the blood-money of what he wounded, he pays it and keeps his slave; if he wishes to hand over the slave, he hands him over, and owes nothing beyond that. His master has the choice in this. 1
