Summary
Malik said: whoever gives a gift without seeking its return, and then the recipient dies, his heirs stand in his place. If the giver dies before the recipient takes possession of his gift, the recipient has nothing, because he was given a gift he did not take possession of. If the giver wants to keep it, having witnessed it when he gave it, that is not his right; when its owner claims it, he takes it. 1
