Summary
Malik says: if they stipulate that the crop be shared between them, there is no harm in that, provided all the costs fall on the partner who enters the partnership: seed, watering and all the work. If the partner stipulates on the owner that the seed is on him, that is not permitted, because he has stipulated on the owner an increase he gains from him. The irrigation partnership is only on the basis that the partner who enters bears all the costs and expenses, and none falls on the owner. That is the known form of irrigation partnership. 1
