Summary
Malik says: if a man gives his palm grove on irrigation partnership and there is open land within it, whatever the partner who enters the land plants in the open land is his. If the owner of the land stipulates that he will plant in the open land for himself, that is not proper, because the man who enters the partnership waters the land for its owner, and that is an increase he has gained at his expense. 1
