Summary
Malik says: the practice among us is that there is no harm in partnership, transfer and rescission in food and other goods, whether or not it has been received, if it is in cash, and there is no profit, loss or delay in it for either of them. If profit, loss or delay enters from either party, it becomes a sale, which is allowed where a sale is allowed and forbidden where a sale is forbidden, and it is not partnership, transfer or rescission. 1
