Summary
Malik transmits from Yahya ibn Said, from Bukayr ibn Abdallah ibn al-Ashajj, from Muawiya ibn Abi Ayyash al-Ansari, that he was sitting with Abdullah ibn al-Zubayr and Asim ibn Umar ibn al-Khattab (may God be pleased with him) when Muhammad ibn Iyas ibn al-Bukayr came and said: a man from the desert divorced his wife three times before he had consummated the marriage; what do you think? Ibn al-Zubayr said they had no view on it, and told him to go to Abdullah ibn Abbas (may God be pleased with him) and Abu Hurayra (may God be pleased with him). He asked them. Ibn Abbas said to Abu Hurayra: give your ruling, Abu Hurayra, for a difficult question has come to you. Abu Hurayra said one divorce separates her and three forbid her until she marries another, and Ibn Abbas agreed. Malik said this is the practice among us. 1
