Summary
Malik says about a free man's mother of a child (umm walad) whom the polytheists seized and then the Muslims took as booty and were divided in the shares, and then her master recognised her after the division: she is not enslaved; he holds that the imam should ransom her for her master, and if he does not, her master must ransom her and not leave her. Nor does he hold that whoever receives her may enslave her and make her lawful to himself; she is like a free woman. 1
