Summary
Malik said: the matter agreed among us regarding the thief found in the house having gathered the goods but not taken them out: he owes no cutting. This is like a man who places wine before him to drink and does not drink it: there is no prescribed punishment for him. And like a man who sits with a woman in a forbidden seat, wanting to have unlawful intercourse with her, and does not do it: there is no prescribed punishment for him. 1
