Muwatta 2158

Malik transmits from Yazid ibn Abdallah ibn al-Had, from Muhammad ibn Ibrahim ibn al-Harith al-Taymi, from Sulayman ibn Yasar, from Abdallah ibn Abi Umayya, that a woman whose husband died observed four months and ten days, then married when her waiting period ended. She stayed with her second husband four months and a half, then gave birth to a full-term child. Her husband came to Umar ibn al-Khattab (may God be pleased with him) and told him. Umar summoned old women of the Jahiliyya and asked them. One of them said: I will tell you about this woman. Her husband died when she was pregnant by him, blood flowed on her, so the child remained stunted in her belly. When her second husband had intercourse with her and the child received water, it moved in her belly and grew. Umar believed her and separated them, and said: I have heard nothing but good of you both, and attached the child to the first husband. ¹
