Summary
Malik transmits from Yahya ibn Said, from Said ibn al-Musayyab, that a man from Syria, called Ibn Khaybari, found a man with his wife and killed him, or killed her. The judgment became unclear to Muawiya ibn Abi Sufyan, so he wrote to Abu Musa al-Ashari (may God be pleased with him) asking Ali ibn Abi Talib (may God be pleased with him) for his ruling. Abu Musa asked Ali, who said: I am Abu al-Hasan: if he does not bring four witnesses, let him be given over with his full price. 1
