Summary
Malik says: if the value of the pledge is more than what the pledgee claimed for it, he swears to what he claimed, and then the pledgor is given the surplus of the value. If its value is less than what the pledgee claims for it, he swears to what he claims he has in it, then settles with the value of the pledge, and the debtor swears to the surplus that remains for the defendant after the price of the pledge. The one holding the pledge has become a claimant against the pledgor. If he swears, the rest of what the pledgee swore to above the pledge's value falls from him; if he refuses, what remains of the pledgee's right after the pledge's value is binding on him. 1
