Summary
Malik says: the explanation, as we see it, God knows best, is that a man pledges an item to another for a thing, and the pledge is worth more than what it secures. The pledgor says to the pledgee: if I bring you your right by a term he names, well; otherwise the pledge is yours in exchange for what it is worth. This is not proper and not lawful; this is what is forbidden. If the owner brings the thing for which he pledged it after the term, it is his. I consider this condition void. 1
