Summary
Malik says: the practice among us is that when a claimant makes a claim against a man, it is examined: if there was dealing or contact between them, the accused is made to swear; if he swears, that right falls from him; if he refuses to swear and returns the oath to the claimant, and the claimant swears, he takes his right. 1
