Summary
Malik says: as for when a man buys the share of his partner, and one of the partners says: I take pre-emption in proportion to my share; and the buyer says: if you wish to take all the pre-emption, I surrender it to you, and if you wish to leave it, leave it. If the buyer gives him this option and surrenders it, the pre-emptor has only to take all of the pre-emption or surrender it to him. If he takes it, he has the better right to it; otherwise he has no share in it. 1
