Summary
Malik says of a man who bought a share of jointly owned land for a price on credit, and the partner wanted to take it by pre-emption. Malik said: if the buyer is solvent, the partner has pre-emption at that price for that term. If the buyer is feared not to pay the price by that term, and the partner brings a trustworthy solvent guarantor like the one who bought from him the share in the jointly owned land, that is his right. 1
