Summary
Malik says: whoever gives a gift in a jointly owned house or land, and the recipient does not return anything, nor asks for anything, and then his partner wishes to take it at its value: that is not his right, unless a return is given. If a return is given, it belongs to the pre-emptor at the value of the return. 1
