Summary
Malik says of a man who bought a share of land together with some people, in exchange for an animal, a slave, a slave-girl, or other goods. Later a partner came to claim pre-emption, and found that the slave or slave-girl had died, and nobody knows its value. The buyer says the value of the slave or slave-girl was a hundred dinars, and the pre-emptor says it was fifty. Malik said: the buyer swears that the price he paid was a hundred dinars. Then the pre-emptor may take or leave, unless he brings evidence that the value of the slave or slave-girl was less than what the buyer said. 1
