Summary
Malik says: the sale of folded goods on a sample (barnamaj) differs from the sale of wood in its case, or cloth in its fold, and the like. He differentiated between them according to the practice that is observed and known in the minds of the people, and the custom of the leading scholars in this, that it has always been among the lawful sales between people which they consider not harmful, because the sale of folded goods on a sample, unopened, is not intended as uncertainty, and does not resemble touching. 1
