Summary

Malik says: there is no harm in a man depositing a dirham with another, and then taking from him for a quarter, a third, or a known fraction, a known item. But if there is no known price in that, and the man says: I will take from you at the price of each day, this is not lawful, because it is uncertainty; it sometimes falls and sometimes rises, and they have not parted on a known sale. 1
