Summary
Malik says: the practice among us is about someone who advanced payment for food at a known price for a stated term, and the term fell due, and the buyer did not find from the seller what he bought, so he rescinded the sale. He should only take back his silver or his gold, or the exact price paid to the seller, and he should not buy anything with that price until he has received it. If he takes other than the price paid, or spends it on goods other than the food he bought, that is selling food before taking possession of it. Malik said: the Messenger forbade the sale of food before it is taken possession of. 1
