Summary
Malik says: the agreed practice among us is that whoever buys a slave-girl who then becomes pregnant, or a slave whom he frees, or any matter that has passed beyond return, and a witness establishes that there was a defect in the slave at the time of sale, by confession or otherwise, then the slave or slave-girl is valued as she was on the day of purchase with that defect, and the difference between her value sound and her value with the defect is returned from the price. 1
