Summary
Malik says: the agreed practice among us is that when the buyer stipulates the slave's property, it is his, whether it is in cash, debt or goods, whether he knows of it or not. If the slave has more property than what was paid for him, its price is cash, debt or goods, because a slave's property is not subject to zakat for his master. If the slave has a slave-girl, the master lawfully enjoys her intimately by ownership. If the slave is freed or enters a contract of manumission, his property follows him. If he goes bankrupt, the creditors take his property, and they do not pursue his master for any of his debts. 1
