Inhilal (dissolution, invalidation and the ending of an obligation)

الانحلال

Inhilal in the lexical sense is coming apart; for the jurists it means invalidity, dissolution, rescission and cancellation. It is applied properly to ending what was formed. 12 It occurs mostly in oaths, divorce and contracts: an oath is dissolved when its condition occurs, when the object of the pledge ceases, by breaking it, by an exception, or, for some jurists, by the ending of the marital bond. 23 Contracts are dissolved by rescission by either side, by mutual consent, by judgement or by iqala (mutual cancellation). 3

Definition

Inhilal in the lexical sense is coming apart. For the jurists it means invalidity, dissolution, rescission and cancellation; invalidity is the wider term, since dissolution applies only to what has been formed. 12

Where it occurs

  • Oaths: an oath to do what is obligatory or to leave what is forbidden is dissolved in a way that is obligatory, and one about recommended or disliked acts is dissolved in a recommended way, following the hadith "when you swear to an oath and see that something else is better, do the better and atone for your oath". 2
  • Ways an oath is dissolved: the occurrence of the condition, the disappearance of the object, the fulfilment or breach, an exception, the ending of the marital bond by divorce for some jurists, and apostasy for some. 23
  • Contracts: dissolved when a non-binding contract is ended, by rescission by agreement or by judgement, or by mutual cancellation. 3

Ahliyya (legal capacity: to have rights and duties, and to act; its stages from the womb to full maturity, and what impairs it)

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
