Democracy and the Sharia — compatibility and conflict

الديمقراطية والشريعة — التوافق والتعارض

The 'Al-Wasatiyya' episode on democracy and Islam. The audience voted: 16% saw it conflicting with the sharia, 42% saw no conflict, 42% partial conflict. 1 On the Islamists' record in it: 40% successful, 60% failed. 2 Azzam al-Tamimi distilled the issue by splitting democracy into a procedural arm (elections, oversight, rights — unproblematic for the panel) and a philosophical legislative arm (the real dispute), insisting no recognised Western philosopher makes secularism a prerequisite of democracy. 3 4

The episode and the vote

The third 'Al-Wasatiyya' episode debated 'democracy: justice or despotism?' and its relation to Islam 5. The audience voted on its conflict with the sharia: 16% agreed, 42% disagreed, 42% partially agreed — a marked shift on which Ishaq al-Farhan commented: twenty-five years ago the prevailing view was 'democracy is unbelief'; today most youth take it as a mechanism for collecting majority opinion 1 6 7 8.

The dissection — procedural and philosophical

Azzam al-Tamimi split liberal democracy into two arms: the procedural — electing the ruler, holding him accountable, rule of law, basic rights — on which the panel found no problem, and the philosophical legislative arm where the real dispute sits; and reported from his doctoral research that no recognised Western philosopher makes secularism a prerequisite of democracy — 'whoever insists on that is either a Westerner who does not want Islamists to succeed through it, or a Muslim who misunderstands it' 3 9 10 4 11. The host summarised: the problem narrowed to 'parliament's right to legislate' 12.

Adopting versus engaging — sovereignty

Munir al-Bayati drew the distinction precisely: democracy becomes 'tyranny of the majority' if the nation is granted unrestricted legislation, colliding with 'the judgement is God's alone' — but adopting it is one thing and engaging with it another; when the benefit to Islam and Muslims outweighs, entering becomes obligatory, not merely permissible 13 14 15 16 17. Abd al-Latif Arabiyat agreed with a clarification: the confusion mixes the foreign term with the Islamic meaning — shura as the people's authority under God's sovereignty — and testified that his own parliament voted on banning alcohol and it failed 18 19 20 21.

The Islamist record — success or failure

The audience voted 60% failure, 40% success 2. Al-Farhan objected: Islamist electoral success made the West recalculate — 'they call for democracy until it brings Islamists to power, then back the tyrants' — citing Hamas in Palestine, Justice and Development, and the Turkish experience 22 23 24 25 26. Ali al-Atoum judged the record 'partially successful' but rulers will never permit Islamists to reach power — recalling Algeria — and the worthier path is seeking an authentic alternative 27 28 29 30. Mahdi al-Dajani said participation is a step toward imitating the Western model, not toward establishing God's rule 31 32. Arabiyat replied: democracy's mechanisms bring us nearer to Islam — pluralism, rotation of power, rights — and gradualism is necessary since building person, family and society cannot be decreed overnight 33 34 35.

Ahliyya (legal capacity: to have rights and duties, and to act; its stages from the womb to full maturity, and what impairs it)

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
