Iltisaq (adhesion of things, and its rulings)

التصاق

Iltisaq is the joining of one thing to another with no gap between them. 1 It may happen by itself or by intent, and it carries rulings: for the Hanafis, a neighbour whose house adjoins a house on a through street has priority of pre-emption, and a splint fixed to a wound allows wiping over it in ablution. 12 Some joining is obligatory, such as the forehead touching the ground in prostration; some is forbidden, such as two men or two women under one cloth without a barrier. 1

Definition

Iltisaq and iltizaq have the same meaning: to stick to a thing. Iltisaq is the joining of one thing to another with no gap, by stickiness, cohesion or contact. The jurists use the word in the same sense. 1

Ruling

Adhesion may happen by itself, as when houses join or leaves stick to water, or by intent, as when a splint is fixed to a wound. 1

  • A house joining another on a through street gives the neighbour priority of pre-emption for the Hanafis; the other schools do not recognise pre-emption by neighbourhood. 1
  • A splint fixed to a wound allows wiping over it in ablution. 12
  • Some adhesion is obligatory, such as the forehead touching the ground in prostration; some is forbidden, such as two men or two women under one cloth without a barrier. It is disliked with a barrier and without intent of pleasure. 1

Ahliyya (legal capacity: to have rights and duties, and to act; its stages from the womb to full maturity, and what impairs it)

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
