By Nazir Ayyad

حكم بيع كتب تتضمن أخطاء علمية ومخالفات شرعية

A question on selling books said to contain religious violations, which Egypt's Dar al-Ifta answered according to the purpose of the sale and the buyer. Dar al-Ifta answered that selling scholarly books is permitted when the seller owns them and they contain something of benefit. It said books that the competent scholarly committees have found to contain violations and errors, and have not licensed for publication, may be sold to scholars, specialists and students for study and refutation, or for pulping and recycling. Selling them to others for circulation and use of their contents it held to be forbidden, as helping falsehood, on the rule that means take the ruling of their ends.

Sale of the prohibited

The prohibition of selling the prohibited in the forty-fifth hadith of Ibn Rajab's additions: 'God and His Messenger forbade the sale of wine, carrion, swine and idols' — so what is forbidden to eat or benefit from is forbidden to sell, the extension of the prohibition to its price being drawn from the question over carrion fat sought for caulking, oiling and lighting — answered 'no, it is forbidden' — and from the saying 'God fight the Jews: God had forbidden them the fat, so they melted it, sold it and ate its price' — the rule being that whatever's substance is forbidden, its price is forbidden too, and altering its form does not make it lawful (Jami' al-Ulum wal-Hikam p. 871).
