Malik was asked whether the extra share can be given from the first booty; he said: that is by the imam's judgment; there is no known settled command among them on that except the sultan's judgment. It did not reach him that the Messenger of God ﷺ gave extra shares in all his raids, though it reached him that he did so in some of them, at Hunayn. 1
