Summary
Malik was asked whether one who kills an enemy may take his spoils without the imam's permission; he said: that is not for anyone without the imam's permission, and it is not given by the imam except by way of his judgment. It did not reach him that the Messenger of God ﷺ said whoever kills an enemy has his spoils, except at Hunayn. 1
