Summary

Malik was asked about a man whose slave was seized by the polytheists and then taken as booty by the Muslims. He said: his owner has more right to him without price or value, so long as the shares have not been distributed; if the shares have been distributed, he holds that the slave belongs to his master for the price, if he wishes. 1
